Re: C# 0923389

Dear Mr. Carr:

I have received and reviewed your application for an expungement of your record of arrest or conviction. It is the position of the District Attorney's office that under Oregon law you are not currently eligible to have your record expunged because arrest for VRO is civil and not criminal. ORS 137.225. I can be contacted at 503-988-3405 if you would like to discuss this matter.

If you still want to schedule a court hearing on your motion to set aside please contact Ginny Holter at 503-988-5313 within the next 30 days. At the close of 30 days if you have not contacted our office to schedule a court hearing, we will petition to have your expungement application dismissed.

Very truly yours,

MICHAEL D. SCHRUNK
District Attorney
Multnomah County, Oregon
