Respondent moves this court for an extension of time of 49 days from June 1, 2007, through July 20, 2007, within which to serve and file the respondent's brief in this case.

The Notice of Appeal in this case was filed on April 21, 2006. The respondent's brief is due on June 1, 2007. This is the first request for a time extension since the court granted defendant's motion to supplement the record.

In support of this motion, I certify that this extension is requested on behalf of Christina M. Hutchins, the attorney assigned to this case. She has been unable to complete the respondent's brief because she has been working on the following cases: Houston v. Brown, A129815 (respondent's brief filed on 03/15/07); State v. Wierson, A131681 (respondent's brief filed on 04/11/07); State v. Cauhey, A132718 (respondent's brief filed on 04/17/07); State v. Salle, A128840 (respondent's brief filed on 04/24/07); State v. Remick, A126870 (oral argument presented on 04/30/07; and T.R. v. Boy Scouts of America, 5054071 (Amicus Curiae brief filed on 05/30/07).

Defendant presently is not incarcerated.

This case is not scheduled for oral argument.

We did not attempt to contact the opposing party who appears pro se in this matter.
